Preference for Resident Suppliers or Contractors Ordinance 16-08 Approved 1/27/2016
The city shall grant a 5% preference to resident suppliers or contractors for purchases under $20,000.00. If the resident supplier is within 5% of the lowest quoted non-resident supplier, the resident supplier will have the opportunity to match the lower quoted amount in writing within 72 hours, provided they possess a current city business license and are otherwise qualified and meet all applicable specifications. OF LEGAL JUSTIFICATION
REGARDING CANCELATION OF THREE ADVERTISEMENTS FOR BID

Advertisement for Bid: a Part of Parcel # 21-30-300-029 (Airport Area, approx. 22.80 acres)
Advertisement for Bid: a Part of Parcel # 20-34-101-001 (Sycamores Area, approx. 6.5 acres)
Advertisement for Bid: Parcel #’s 20-27-427-011/20-27-427-012 (Maple Hills Area, approx. 9.68 acres)


Facts: As identified above, there were three “processes” for “Advertisement for Bid of Real Property” for which bid openings were held on July 8, 2016. The record indicates that each of the three bid openings was held in accordance with all applicable state and local procurement laws and policies. Subsequent to these bid openings, the City Manager, Mark R. Palesh, has canceled these three processes. Consequently, no bids have been or will be approved (and no contracts have been or will be awarded) for any of these processes.

Legal Authority: Each of the three bidding documents (each entitled “Advertisement for Bid of Real Property”) contains a statement reserving the City’s “right to reject any or all bids.” Moreover, Utah Code Ann. Section 63G-6a-606 and West Jordan Municipal Code Section 3-1-4 allow the City Manager to cancel Advertisements for Bid without awarding contracts. These Code Sections also require that the City make available for public inspection a written justification for the cancelations. The purpose of this Public Notice is to comply with these legal requirements by providing a written list of legal justifications for the cancelations.

Legal Justification: The justification for the cancelations of the three above-referenced processes includes:

1. For the Maple Hills Area bid opening, there was only one bid. The dollar amount of this bid was well below the minimum bid price.
2. All of the other bids (for the other two bid openings) were at or below the minimum bid price.
3. Many of the bids added alterations, which contradict the express terms of the Advertisements for Bid.
4. One alteration in some of the bids was delaying payment to the City until after the City’s final approval of rezoning or subdividing the real property. Each Advertisement states that “a non-refundable payment” shall be paid “within ten (10) calendar days” and “[t]he balance . . . shall be paid within 180 calendar days . . . .”
5. To provide a degree of certainty regarding the potential future development of the referenced real property (identified in each Advertisement for Bid), City staff has recommended Future Land Use Map and Zoning Map Amendments for each of the referenced parcels before any new Advertisement for Bid processes.
6. In summary, each of the bids for each of the three Advertisements for Bid: (a) were at or below the minimum bid price; and/or (b) requested some form of alteration to the published bidding document. Therefore, the three above-referenced Advertisements for Bid have been canceled due to noncompliance.

The City of West Jordan, Utah is seeking sealed bids from companies or individuals to purchase 261 surplus wooden pallets from the City.

REQUEST FOR PROPOSALS
The City of West Jordan Utah is seeking Proposals from firms to furnish Park Signage at various locations throughout West Jordan City. Proposals to include materials and installation of the products.

The estimate is $3,000.00 per sign.

Proposals will be received by the City of West Jordan, City Clerk’s Office, 8000 South Redwood Road, West Jordan, Utah 84088 until Thursday, August 4, 2016 at 2:00 P.M. at which time the names of those firms who submitted proposals shall be publicly announced. Proposals shall be deemed received when they are in the physical possession of the City Clerk/Recorder or designee.

The City of West Jordan Utah is seeking bids for a contractor to furnish all equipment, labor, materials, and appurtenances for the Manhole Raising project.

The engineer’s estimate for this project is $50,000.00.
