PUBLIC NOTICE OF LEGAL JUSTIFICATION
REGARDING CANCELATION OF ADVERTISEMENT FOR BID

Advertisement for Bid: a Part of Parcel # 21-30-300-029 (Airport Area, approx. 22.80 acres)

Facts: As identified above, there was a “process” for “Advertisement for Bid of Real Property” for which bid opening was held on September 20, 2016.  The record indicates that the bid opening was held in accordance with all applicable state and local procurement laws and policies.  Subsequent to this bid opening, the City Manager, Mark R. Palesh, canceled this process.  Consequently, no bids have been or will be approved (and no contracts have been or will be awarded) for this process.

Legal Authority:  The bidding document (titled “Advertisement for Bid of Real Property”) contains a statement reserving the City’s “right to reject any or all bids.”  Moreover, Utah Code Ann. Section 63G-6a-606 and West Jordan Municipal Code Section 3-1-4 allow the City Manager to cancel Advertisements for Bid without awarding contracts.  These Code Sections also require that the City make available for public inspection a written justification for the cancelations.  The purpose of this Public Notice is to comply with these legal requirements by providing a written list of legal justifications for the cancelations.

Legal Justification:  The justification for the cancelation of the above-referenced process includes:
1. There was only one bid for the Airport Area bid opening and the dollar amount of this bid was lower than anticipated.
2. Therefore, the above-referenced Advertisement for Bid has been canceled.
